Terms of Service

Grimoire is a web application for Magic: The Gathering Commander playgroups. It lets users record games, track life totals during play, and view statistics over time. Grimoire is provided as a free service during its current stage of development.

You must create an account to use Grimoire. Sign-in is by magic link sent to your email address, or by Google or Discord OAuth. You are responsible for keeping your email account or OAuth account secure, and for all activity carried out under your Grimoire account.

You must be at least 16 years of age to use this service.

Playgroup owners and members own the content of their playgroups — player names, decks, locations, games, and notes. The operator does not claim rights to it, and stores and processes this data on the playgroup's behalf so the service can function.

When you enter another person's name, you confirm that you have a lawful basis to do so under the GDPR (such as consent or another applicable basis).

The Grimoire name, logo, and original software code remain the property of the operator.

You agree not to:

• Scrape, crawl, or use automated means to access Grimoire.
• Attempt to access or modify another playgroup's data.
• Abuse the magic-link or invitation flow to spam other users.
• Enter personal data of third parties without a lawful basis under the GDPR.
• Use the service for any unlawful purpose.
• Attempt to circumvent authentication or authorization.

To the maximum extent permitted by applicable law, Grimoire's total liability to you for any claims arising from or related to your use of the service is limited to the total fees you have paid to Grimoire in the twelve (12) months preceding the claim.

Nothing in these terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) intentional misconduct (Vorsatz) or gross negligence (grobe Fahrlässigkeit), in accordance with Directive 93/13/EEC and German Civil Code (BGB) §§ 305-310.

As Grimoire is currently provided free of charge, the effective liability cap is zero euros. This does not affect the mandatory liability carve-outs listed above.

Either party may terminate this agreement at any time. You may stop using Grimoire and request account deletion by contacting info@grimoire-mtg.quest.

We may suspend or terminate your account if you violate these terms.

Upon termination, your data will be handled in accordance with our Privacy Policy.

These Terms of Service are governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict-of-law provisions.

If you are a consumer residing in the European Union, you may bring legal proceedings in the courts of your country of residence in accordance with EU Regulation 1215/2012, Article 18.

Nothing in these terms affects your rights as a consumer under applicable mandatory consumer protection laws.

We may update these Terms of Service from time to time. The “Last updated” date at the top of this page indicates when the terms were last revised. Material changes will be communicated by email to account holders; minor changes will be posted here. Continued use of Grimoire after a non-material change constitutes acceptance of the updated terms.
